Real Estate investments may give residence permits to foreigners in Brazil

There is a high demand to get a visa to Brazil, which ends up making the process tiring for a foreigner who is not aware of our laws or who tries to enter a process without advice. A series of documents and vouchers are required that end up making everything more difficult.

But did you know that it is possible to facilitate your entry and increase your chances of getting a visa? A very efficient way is to invest in the Brazilian real estate market. According to Law No. 13.445, the Ministry of Justice and Public Security may grant residence permits to foreigners who invest in the Brazilian real estate market.

Investment

Taking advantage of the flexibility that has been granted to foreigners in relation to entry into the country, the foreigner who wants to reside in Brazil can have his/her residential visa approved more easily being an investor in the Brazilian real estate market.

There are some requirements regarding the value of the investment that must be met:

  • Acquisition of real estate built or under construction with a minimum value of R$1,000,000.00 (one million reais);
  • If the investment exceeds R$1,000,000.00 (one million reais), proof of financing of the amount exceeding the initial value may be presented;
  • In the case of acquisitions in the north and northeast regions, the minimum value required will be R$700,000.00 (seven hundred thousand reais);
  • The acquisition of real estate at a lower cost can be proven, provided that the sum of them is equal to or greater than R$1,000,000.00 (one million reais);
  • It is allowed to enter the application as co-owner, however both parts of the company need to invest the minimum values mentioned above.

Documents

The Ministry of Justice and Public Security requires some documents to be presented in order for the visa authorization to be carried out and the foreigner to be able to obtain the residence visa.

Above we say that one should acquire a property built or under construction (one can consider land) in an urban area, but there is a difference in the documentation of both that one should pay attention to.

Built properties:

  • General registration of the property, free of liens and charges, proving that the investor is in fact the owner;
  • Declaration of a credit institution authorized or registered in national territory with the Central Bank of Brazil, attesting to the international transfer of capital for the acquisition of real estate in the defined value.

Properties under construction:

  • Property Purchase and Sale Promise Agreement, duly registered;
  • Declaration of a credit institution authorized or registered in national territory with the Central Bank of Brazil, attesting to the international transfer of capital for the acquisition of real estate or for the payment, as a sign in the Purchase and Sale Promise Agreement, of defined value;
  • Construction Permit issued under Brazilian law; and
  • Memorandum of Incorporation duly registered.

Important points

In addition to the documentation, there are some important points that the foreign investor should be aware of, as each of them may imply obtaining and/or maintaining the visa.

Points that are:

  • The duration of the visa is a maximum of 4 years, and may be renewed upon presentation of some documents;
  • After the period of residence provided for, the authorization may be changed indefinitely, provided that the documents provided for are presented: a) documents proving that the investment is maintained; b) a copy of the National Migration Registration Card (CRNM); and c) criminal record certificates or equivalent document, issued by the competent judicial authority from where you have resided during the temporary residence authorization.
  • The investor must remain on Brazilian soil for a period of 14 (fourteen) days, consecutive or interspersed, for a period of 2 years from the registration with the federal police;
  • In case of missing the deadline or non-compliance with the requirements mentioned in the topics above, the investor may make a new visa application provided that the investment made is maintained;
  • Whenever deemed necessary, the Ministry of Justice and Public Security may carry out an investigation at the place where the property is registered;
  • If there is a lack of information or falsity of any document presented, the application for a residence visa will be canceled.

We can see that there are different routes for the foreigner who intends to obtain a residence visa in Brazil. One of the interesting means is to become an investor, as you will have a number of benefits and facilities that in other situations will not happen.
